1. Scope of application

The General Terms and Conditions (hereinafter referred to as “GTC’s”) apply to orders placed and contracts concluded via the online stores of pmtb.ch. 

The online store reserves the right to change the GTC’s. The version of the GTC’s valid at the time of the order is decisive in each case, which cannot be changed unilaterally for this order. 

2. Offer

The offer is directed to customers with residence in Switzerland or Liechtenstein. Deliveries will only be made to addresses in Switzerland or Liechtenstein. 

The offer is valid as long as it is visible in the online store and/or stocks last. Price and product range changes are possible at any time. The images shown in advertising, brochures, in the online store, etc. are for illustration purposes and are not binding.

3. Store reservation

Currently no location available for pickup.

4. Order

The presentation of the products in the online store is not a legally binding application, but a non-binding online catalog or a non-binding invitation to the customer to order the product and / or service in the online store. 

An order is considered an offer to the online store to conclude a contract. 

After transmission of the order, the customer automatically receives a confirmation of receipt, which documents that the order has been received by the online store. After receipt of this confirmation of receipt, the customer can no longer change the orders and is bound to them. 

The online store is free to reject orders in whole or in part without giving reasons. In this case, the customer will be informed and any payments already made will be refunded. Further claims are excluded.

5. Conclusion of contract

A contract comes only through the shipment of the ordered products or agreement on the delivery date. As soon as the order has been shipped, the customer will be informed by e-mail. 

6. Price

The prices are in Swiss francs, including value added tax (VAT) and, if applicable, including prepaid recycling fee (“vRG”). 
The price in the online store at the time of the order is decisive.

7. Payment variants

Payments must be made in Swiss francs.
The online store generally requires payment in advance. In case of prepayment, the delivery will be made only after receipt of payment. The ordered products are not reserved until receipt of payment and may be out of stock in the meantime.

8. Reservation of proprietary rights

Ordered products remain the property of the online store until full payment. The online store is entitled to make a corresponding entry in the retention of title register. Before transfer of ownership, pledging, transfer by way of security, processing or transformation without the express consent of the online store is not permitted.

9. Delivery variants

Delivery (parcel delivery / home delivery)

The delivery address must be in Switzerland or Liechtenstein and easily accessible by truck. 
Home delivery usually includes delivery of the order to the curb.

Home delivery does not include any other services, such as unpacking and assembly of the purchased item, return of packaging material, etc. The costs for home delivery are shown separately in the shopping cart and on the invoice, in addition to the price of the ordered products.
In case of delivery addresses without access road or difficult access, delivery will be made to the nearest access point or railroad station. If the customer nevertheless wishes delivery in front of/to the house, he/she must bear the additional costs or pay them in advance. The customer is responsible for obtaining permits, making available extraordinary auxiliary equipment or making adjustments on site. If products cannot be transported to the destination through the house/apartment door or the staircase, additional costs will be incurred which must be borne by the customer.

If products are delivered with obvious damage to the packaging or contents, the customer must immediately complain to the service provider (e.g. carrier, post office) and refuse acceptance, without prejudice to their warranty rights. The customer is obliged to obtain a damage confirmation report from the service provider (e.g. forwarding agent, post office). All transport damage must also be reported immediately to the online store. 

If the customer does not accept the ordered products on the agreed delivery date, the online store may charge the customer for the delivery costs and expenses incurred and reserves the right to withdraw from the contract.

The costs for home delivery are shown separately in the shopping cart, in addition to the price of the ordered products.

10. Delivery date

The delivery times stated in the online store are non-binding. They begin to run from the order or, in the case of advance payment, from receipt of payment. 

With the confirmation of receipt of the order, the customer will be notified of a provisional delivery date. In the case of home delivery, a date will be agreed with the customer when the goods are ready for delivery. 

11. Right of return

A return is possible within 10 calendar days after store pickup or from the date of the postmark or the delivery or receipt confirmation. If the customer cannot show the delivery or receipt confirmation, the 10-day period starts from the date of dispatch of the order. 

The product must be returned in its original packaging, undamaged, clean, complete, including any accessories. Any seal must not be broken. 

Excluded from the right of return (but not from warranty claims) are: Consumables.
 
The product must always be returned with proof of purchase and, if a return slip was enclosed with the delivery, with the completed return slip as follows:

  • Parcel shipment: If the product was sent as a package, it must be sent to the address indicated on the return slip.
  • Home delivery: If the product was delivered by home delivery service, the desired return must be notified in writing to the online store, so that the collection can be organized by the online store.

The costs for the return are to be borne by the customer.

If the customer returns the product in its original packaging, undamaged, clean, complete, including any accessories and proof of purchase, the payment already made will be refunded to the customer after deduction of any services already rendered. An exchange is not possible.

12. Warranty

The warranty certificate is sent by e-mail at the same time as the customer’s order is sent when buying online. The warranty certificate or proof of purchase must be kept carefully. If it is missing, the warranty claim will be invalidated. 

The warranty shall cover the freedom from defects and functionality of the product purchased by the customer for a period of two years from the date of conclusion of the contract or the date of the postmark or the delivery or receipt confirmation. 

Normal wear and tear as well as the consequences of improper handling or damage by the customer or third parties as well as defects that can be attributed to external circumstances (e.g. normal power loss of rechargeable batteries, leaking batteries, data loss, software errors, computer viruses, changes made to the product, frost, lightning) are not covered by the warranty. The warranty obligation expires in case of repairs by unauthorized service centers. 

The online store can provide warranty service either by free repair, equivalent replacement or refund of the purchase price. Further claims are excluded.

13. Notice of defects

If products are delivered with obvious damage to the packaging or contents, the customer must, without prejudice to their warranty rights, immediately complain to the service provider (eg carrier, post) and refuse acceptance. The customer is obliged to obtain a damage confirmation report from the service provider (e.g. forwarding agent, post office). All transport damage must also be reported immediately to the online store.

Furthermore, it is the customer’s responsibility to inspect the ordered products immediately upon receipt and to report any defects or deviations from the order in writing to the online store within 10 calendar days. After that, only hidden defects can be claimed. 

A defective product must be returned immediately to the address indicated on it, together with the proof of purchase and any return slip.

14. Privacy Policy

The online store points out that the data recorded during the conclusion of the contract will be collected, processed and used to fulfill the obligation arising from the purchase contract. The data necessary for the provision of services and fulfillment of the contract may also be passed on to commissioned service partners (e.g. logistics companies, service partners, debt collection companies), including in countries which may not have an equivalent level of data protection. By agreeing to these GTC’s, the customer agrees to this use of data.

15. Applicable law and jurisdiction

The legal relationship between the online store and the customer is governed by Swiss substantive law, excluding conflict of law rules and the Vienna Sales Convention.
